COURT APPROVED SETTLEMENT
Raisner Roupinian LLP filed a class action suit on May 5, 2021, against GDC Technics, LLC (“GDC”), seeking to recover 60 days’ wages and benefits for former employees under the Worker Adjustment and Retraining Notification (“the “WARN Act”) and for unpaid vacation pay under the Texas Payday Act. We contended GDC ordered mass layoffs at its facilities on or about April 9, 2021, without providing its employees with 60 days’ advance written notice. The case is pending in the United States Bankruptcy Court for the Western District of Texas.
On November 2, 2021, the Court certified a class comprising WARN Act and vacation pay claims. Additionally, the court appointed Raisner Roupinian LLP as class counsel, and the plaintiff as the class representative. The settlement administrator mailed notice of the class action to class members on November 22, 2021.
On November 14, 2022, the Bankruptcy Court granted final approval of a $1,375,000 settlement on behalf of the certified class.
Subsequently, the settlement administrator sent individual checks to class members on December 13, 2022.
WARN ACT
Raisner Roupinian LLP will provide you with information regarding your rights in this WARN class action. The federal WARN Act requires companies with 100+ full-time employees to provide them with 60 days’ written notice in advance of a mass layoff or plant closing. Additionally, certain states also have WARN Acts.
Without the required notice, an employer may be liable for 60 days’ wages and benefits to each affected employee.
